On October 8, 2023, California Governor Gavin Newsom signed into law Senate Bill (SB) 497, which makes it easier for employees to establish retaliation claims in California. SB 497 (the Equal Pay and Anti-Retaliation Act) goes into effect on January 1, 2024.
The standard for proving a retaliation claim requires showing that the managers action might deter a reasonable person from opposing discrimination or participating in the EEOC complaint process.
To prove retaliation, you must establish a causal connection between your protected activity and the adverse action taken by your employer. Provide evidence showing that the adverse action occurred shortly after you engaged in protected activity, demonstrating a direct link between the two events.
Under Title VI, the evidence must show that (1) an individual engaged in protected activity of which the recipient was aware; (2) the recipient took a significantly adverse action against the individual; and (3) a causal connection exists between the individuals protected activity and the recipients adverse action.
What are the three elements of retaliation? To establish a claim for retaliation, an employee must prove: (1) that he/she engaged in a protected activity; (2) that the employer subjected him/her to an adverse employment action; and (3) a causal link between the protected activity and the employers action.
