Penal Code 1203.3 PC gives judges the discretion to terminate a defendants probation early. In other words, PC 1203.3 PC gives judges the discretion to grant early termination of probation. The court will simultaneously expunge a defendants record when this occurs ahead of schedule.
In certain cases, a judge may be willing to terminate a defendants probation earlier than the probation expiration date. Under California Penal Code Section 1203.3 PC, a defendant can petition the court for early termination of probation. If granted, the defendants conviction is usually expunged at the same time.
PC 1203.4a Not placed on Probation If you were convicted of a misdemeanor and not granted probation or convicted of an infraction, and more than one year has elapsed since the date of pronouncement of judgment, you may petition the court to dismiss the charges under Penal Code 1203.4a.
Penal Code 1203.3 PC gives the court the discretion to grant a request for early termination of probation at any time during the probation period. In practice, however, most judges want to see you complete at least 12 to 18 months of your probation before they will seriously consider closing your case.
