A: A common law marriage is formed when four conditions are met. First, the potential husband and wife are competent to be married. Second, the marital agreement is entered into by mutual consent. Third, there is cohabitation.
To be married in the State of Indiana, a couple must have a marriage license. To apply for a marriage license in Indiana, both you and your future spouse must appear in person at the Clerks Office in an Indiana county where one of you resides.
Must be at least 18 years of age OR: Parental Consent--Parent or legal guardians must sign Marriage Application and the signatures must be notarized. Counseling--Proof of two counseling sessions, not less than ten days apart. Judicial Approval--A District Court Judge must approve and sign Marriage Application.
Marriage Application Applicants must use the online marriage application system to complete the application. Proof of age, such as a drivers license or passport, is required. Once the online marriage application is submitted, both parties MUST visit the Clerk of Court office to obtain their marriage license.
The license can be used immediately or within 180 days from the date of issuance. It is valid in any county within Montana, but not in any other state or country. After the marriage ceremony, the license must be returned to the Clerks office within 30 days for completion.
