The Mental Health (Care and Treatment) Act (MHCTA) provides for the State to detain persons with or suspected of having mental health conditions, and who may be a risk to self or pose a danger to others, in a designated psychiatric institution for psychiatric assessment and treatment.
The four major forms of mental health care services are delivered in psychiatric hospitals, residential treatment, outpatient care, and dual diagnosis settings.
The act places duties on councils to provide care and support services for people with mental health conditions. The provisions of this act are intended to ensure that care and compulsory measures of detention can be used only when there is a docHub risk to the safety or welfare of the patient or other people.
