The EDD will then schedule a hearing with an EDD judge. Unfortunately, this is a process that can take up to six months from the date that an appeal is submitted by the employee.
At the appeal hearing, do your best to respond honestly, calmly, and directly to the ALJs questions. Its always best to keep your responses concise (ie dont ramble). Its never a good idea to smear (ie say negative things about) the employer.
When you submit an appeal, be sure to explain your reasons for appealing. Include all details, documents, and evidence you want the EDD to review. In some cases, based on the information you provide, we may change a disqualification and find you eligible for benefits. This would eliminate the need for an appeal.
At the hearing, an impartial Administrative Law Judge will listen to both sides of the appeal and make a decision based on facts presented by you and by a State Disability Insurance representative. If you fail to appear, your appeal will be dismissed.
If you lose your appeal, there are not any additional negative consequences. After the judge reviews the case, if you still disagree, you can ask for an additional round of review. Even if the EDD is technically correct that you were not eligible for benefits, you can apply for a waiver of your overpayment.
