A judgment is a court order stating that you owe the debt collector money because of a lawsuit. You may have received a judgment because the court decided in favor of the debt collector in a trial, or because you did not respond to a lawsuit that was filed against you.
A judgment is nothing more than a decision by a court that has been entered into the public record. In order for that decision to be made, someone must file a lawsuit. You get time to formally Answer (thats a technical term, which is why its capitalized) and fight the lawsuit.
The Notice of Entry of Judgment (SC-130) is a court form that states the judges decision. This form also tells you about your rights and lists the date the form was mailed to you. This date is very important. You have only 30 days from this date to file a motion to vacate the judgment or appeal the judges decision.
Being judgment proof means you dont have income, cash reserves, or other assets a creditor can take to pay off a money judgment. Updated by Amy Loftsgordon, Attorney University of Denver Sturm College of Law. Updated 10/11/2024.
you can look at your credit report at .annualcreditreport.com or you can go to the local clerk for the courts and search the county database. If there are judgments in other jurisdictions you would have to look there as well.
