Please completely fill out the HLRB-14 APPLICATION FOR ISSUANCE OF SUBPOENA(S)/SUBPOENA(S) DUCES TECUM (APPLICATION). Type the name, address, and telephone number of the applicant in the top left corner of the APPLICATION. Mark a copy of the subpoenas as an Exhibit (A, etc.) and attach to the Application.
Although it may technically be possible to get a subpoena without a lawyer, doing so carries with it certain risks. For example, if the proper person is not named, the party may not receive the documents that he or she is requesting. The subpoena must be listed in the persons name who actually has the records.
The clerk must issue a subpoena, signed but otherwise in blank, to a party who requests it. That party must complete it before service. An attorney also may issue and sign a subpoena if the attorney is authorized to practice in the issuing court. (4) Notice to Other Parties Before Service.
The subpoena shall show on its face the name and address of the party at whose request the subpoena was issued. b) Subpoenas may be served by personal delivery, by certified mail with return receipt signed by private delivery service, or by U.S. regular mail, postage prepaid.
