The Friend of the Court (FOC) helps the court with custody, parenting time, and child support issues. Among other things, the FOC: Helps parents settle disputes during and after their case. Investigates and makes recommendations about custody, parenting time, and child support.
The court must sign a properly submitted proposed judgment or order if no written objections have been filed within 7 days after service of notice, as long as the judgment or order is consistent with the courts decision. MCR 2.602(B)(3). (This is commonly referred to as the Seven-Day Rule.)
Parties who agree that they do not need the FOCs services do not have to use them in certain circumstances . They may file a joint motion to opt-out and, if the court approves the motion, the parties must then deal with each other directly .
The grievance procedure requires a grievance to first be filed with the county FOC office. The grievance can be prepared on a grievance form or in a letter that is clearly labeled grievance. The FOC director or designee must respond to the grievance within 30 days or provide a reason for the delay in response.
You can complain by phone, in person, or in writing by email or mail. Phone or email first to tell the company about the problem and to try to resolve it. You should be able to learn pretty quickly whether the problem will be resolved.
