In 2019, Texas ended the DRP entirely. This included all past, present, and future surcharges. Texans no longer owed any surcharges after September 1, 2019, and there were no new surcharges after that date.
Under the Driver Responsibility Program, a driver who is convicted of certain offenses, including Driving While Intoxicated (DWI), Driving Without Insurance, Driving Without a License, or Driving While License Invalid, is required to pay a surcharge for a period of three years.
Some judges will now waive all DWI surcharge fees with a court order. Some wont waive all surcharges but will reduce them. The best way to avoid DWI surcharges is to not be convicted in the first place. If your case is dropped or reduced to another charge you do not have to pay surcharges.
DRP requires the Texas Department of Public Safety (DPS) to apply surcharges to individuals with certain traffic convictions. A surcharge is an administrative fee charged to a driver based on the number of points or convictions on the driver record.
Indigency/Incentive Programs Under the Indigency Program, the surcharges are waived. However, under the Incentive Program, the surcharges are not waived but are reduced. The objective is to ensure drivers can become licensed, obtain financial liability insurance, and continue to keep our roads safe.
