The BE-12 benchmark survey is BEAs most comprehensive survey, in terms of both the number of companies covered and the amount of information gathered, on foreign direct investment in the United States. The survey is conducted once every 5 years in place of the BE-15 annual survey.
Foreign-owned U.S. real estate is considered a U.S. affiliate and required to file BE-12. This includes single-unit rental properties partially used by owners, multi-unit residential or commercial properties, and equity REITs engaged in leasing real estate.
That is, if a foreign person (i.e., a non-US company or individual) owns, directly or indirectly, 10% or more of the voting securities of a US company, that US company must file a BE-12. Unlike other BEA filings, a BE-12 must be filed regardless of whether a US Affiliate is contacted by the BEA.
