A conflict of interest exists if a legislator uses their official position to influence a governmental decision in which they know they, an immediate family member or a business they are associated with have a financial interest .
If the decision benefits or appears to benefit the public official, there is a conflict of interest present. In such situations, the official is either disqualified from participating, or should recuse, abstain or delegate the decision to an official who does not possess an apparent conflict of interest.
