The grounds are: citizenship, race, place of origin, ethnic origin, colour, ancestry, disability, age, creed, sex/pregnancy, family status, marital status, sexual orientation, gender identity, gender expression, receipt of public assistance (in housing) and record of offences (in employment).
How long does the Tribunal process take? The goal of the Human Rights Tribunal of Ontario is to hold a hearing within one year of the application being filed. Many applications are resolved earlier through negotiations between the parties or through the Tribunals mediation process.
Compensation for General Damages: General damages provide compensation for the pain and suffering caused by discrimination, addressing the emotional and intangible impact. Past HRTO cases demonstrate a range of awards, from $100 to over $200,000, depending on the severity of the discrimination.
The HRTO resolves claims of discrimination and harassment brought under the Human Rights Code (Code). The Code prohibits actions that discriminate against people based on a protected ground in a protected social area. The HRTO s authority is limited to the enforcement of the Code.
