FORM 14C serves as a formal notice to the defendant that a legal proceeding has been commenced against them by the plaintiff.
Defendants served in Ontario must prepare and file a statement of defence within twenty days, while those served in other provinces or territories have forty days, and sixty days if served outside Canada and the USA.
Instead of filing a statement of defence, defendants can file a notice of intent to defend (Form 18B), which grants an additional ten days to submit their defence.
Failure to respond may result in judgment being entered against the defendant without further notice.
Defendants who wish to defend but cannot afford legal fees may be eligible for legal aid by contacting a local legal aid office.
The action will automatically be dismissed if not set down for trial or terminated within five years unless ordered otherwise by the court.
