A final judgment is usually a prerequisite of review of a courts decision by an appellate court, thus preventing piecemeal and fragmentary appeals on interlocutory (provisional) rulings (see interlocutory decree). A judgment generally operates to settle finally and authoritatively matters in dispute before a court.
Final judgment means a judgment with respect to which all possibility of direct attack by way of appeal, motion for a new trial, or motion under Section 663 to vacate the judgment has been exhausted.
The following exceptions exist to the final judgment rule: Collateral order doctrine under Cohen v. Beneficial Industrial Loan Corp., 337 U.S. 541, 546 (1949) (order determining important collateral rights that cannot be protected on appeal from final judgment).
