An action to revive a judgment is governed by provisions of the Civil Code and Rules of Court. A judgment can be executed by motion within 5 years of entry, but after 5 years it must be enforced through a new court action before the 10-year prescriptive period expires.
A motion for leave to renew must be based upon new facts not offered on the prior motion that would change the prior determination and must also contain a reasonable justification for the failure to present such facts on the prior motion. Unlike with motions to reargue, there is no time limit on motions to renew.
