A Subpoena Duces Tecum (meaning subpoena for production of evidence) is a court order requiring the person subpoenaed to produce books, documents or other records under his or her control at a specified time/place in a court hearing or a deposition.
There are two types of Subpoenas: A Subpoena requiring a witness to attend court is called a Witness Subpoena. A Subpoena requiring someone to bring documents only to Court (no testimony from that person is needed, only the documents are needed) is called a Subpoena for the Production of Documents.
The two most common subpoenas are the Subpoenas Duces Tecum and the Witness Subpoenas for a court proceeding or deposition.
Requests for the issuance of a subpoena must be made in writing and received by the OAH not less than fifteen (15) days prior to the scheduled hearing. The request should include the case name, OAH case number, hearing date, and the complete names and addresses of individuals to be subpoenaed.
Common grounds for objecting to a third-party subpoena for documents include: Improper service. Improper issuance. Vague, ambiguous, and unreasonable requests.
