Good morning. I am Magistrate and this is County Small Claims Court. I am going to read a list of cases that are scheduled to be tried today. If I call your name, or the name of the case you are here for, please stand, identify yourself, and tell me whether you are prepared for your hearing today.
You dont really need an opening statement like you see on TV. Rather, what you need to do is to explain in the first two or three sentences why you are suing the defendant. For example, you can say that this is a landlord tenant dispute.
Its worth it, if you have the proof to win the case. Dont expect the judge to award you court costs even after winning the case, though.
If the person or company youre lodging your claim against doesnt reply within 14 days, you can ask the court for a judgment by default. If this happens, you may win the case by default. Dont rely on this happening just be aware its possible.
How to Structure an Effective Opening Statement Introduction. Start by addressing the jury or judge warmly and professionally. Tell the Story. After introductions, transition into your cases story. Outline the Evidence. Conclude with Purpose. Start Strong. Focus on Clarity. Use Plain Language. Maintain Eye Contact.
