An employee is entitled to Sunday premium pay equal to 25 percent of his or her rate of basic pay for each hour of Sunday work. For this purpose, Sunday work consists of nonovertime work during an employees regularly scheduled basic tour of duty (not to exceed 8 hours) that begins or ends on a Sunday.
Employees receive overtime pay for the greater number of hours worked in excess of 8 per day or 40 per week. There are exceptions for certain employees for whom the first 40 hours of work is the basic workweek and for those employees who have alternative work schedules.
Under the FLSA, overtime pay is one and one-half times an employees regular pay rate for every hour that is worked beyond 40 hours in a workweek. There are exceptions because not everyone is eligible for overtime pay, including exempt employees.
The law states that Forest Service employees who are assigned to a fire and engaged in emergency wildland fire suppression activities receive an overtime rate of 1 times their hourly rate of basic pay, regardless of exemption status, and regardless of the grade (5 U.S.C. 5542 (a)(5)).
Minor changes in duties or factors which do not impact classified pay plan, title, series, or grade, may be documented using a PD amendment (Form FS-6100-13, Position Description Correction Notice or equivalent document). Human Resources Specialists with delegated classification authority shall approve PD amendments.
