Where the value of the net estate exceeds 5,000, the current fee of 155 is payable for resealing. No fee is payable where the net UK estate is less than 5,000. Official sealed copies are currently 50p each.
Resealing is the legal process by which a foreign grant of representation/probate (or equivalent, this would be a document confirming the executors right to administer the deceaseds estate) is sealed by the probate registry, therefore, enabling it to be used for the collection of English and Welsh assets.
If a deceased person owns assets in more than one state or country, then the executor needs to apply for a Reseal of Probate. The reseal is obtained when you apply to the relevant states Supreme Court asking that the court recognise the probates original grant. The process is also known as resealing the grant.
In law, to recuse means to withdraw from a legal case due to a potential conflict of interest or lack of impartiality. This action can be taken by a judge , juror , or other judicial official who recognizes that their involvement in the case could be biased or perceived as biased.
In some cases, you will need to obtain probate in the country in which the Will was prepared, in order to deal with assets in that jurisdiction, and then arrange for the Will to be resealed for use in the UK. This is the format through which the UK Courts recognise the authority of the Will and the executors appointed.
