How Long Does It Take to Evict a Tenant in Ontario? Unfortunately, eviction is not a speedy process. It can take anywhere from 85 138 days to evict a tenant after an eviction notice has been given.
Landlords are required to give their tenant at least 60 days written notice to the end of the term or rent period using the Landlord and Tenant Board Form N12.
You must provide the landlord with your notice no later than 30 days after the landlord gives you the standard lease. In either case, you must provide the landlord with a written notice to terminate the tenancy at least 60 days before the last day of a rental period.
The termination date in the landlords notice of termination must be at least 120 days after the notice is given and must be the last day of a fixed term tenancy, or if there is no fixed term, the last day of a rental period.
If the lease does not have a set length, the tenant must give a written notice one to two months before leaving. If the lease is for 12 months or more, the tenant must give notice to the landlord three to six months before the end of the lease.
If tenants are served with a 3 Day Notice to Pay or Vacate, and if they dont pay, the eviction process in California can start on the 4th day. If they are doing criminal activity a 3 Day Notice to Vacate is also served.
The closest you can get to legally evicting a tenant immediately in Ontario is with a cash-for-keys agreement. This involves the signing of a consent form (ideally drafted by a legal professional), an N11 form, and money from the landlord to help the tenant cover the costs of moving out and finding a new place to live.
In Ontario, when a residential lease expires, and there is no new lease, the tenancy automatically becomes a month-to-month tenancy.
