Small claims basics Generally, you can only sue for up to $12,500 in small claims court (or up to $6,250 if youre a business). You can ask a lawyer for advice before you go to court, but you cant have one with you in court. Starting November 1, 2021, you can sue or be sued for COVID-19 rental debt in small claims.
You will need to obtain a small claims complaint from the court clerk or from .courtselfhelp.idaho.gov. The complaint must include complete names and addresses, the amount you are seeking, when it became due, and a brief statement of why the amount is owed.
Small Claims Court can handle most civil cases in which the amount in controversy is $7,000 or less. You can only get money in Small Claims cases. If you want something other than money, you cant file your case in Small Claims Court.
The amount of money cannot be more than $5,000.00 (plus the cost of the filing fee and the cost of giving notice to the defendant). You cannot sue the defendant for more than $5,000.00 in small claims court.
Small Claims Court handles civil cases asking for $12,500 or less. Here are some examples of problems you can handle in Small Claims Court: Your landlord will not return your security deposit. Someone damaged your car and will not pay for the repairs.
The fee for filing in small claims court depends on the amount of the claim: $30 if the claim is for $1,500 or less, $50 if the claim is for more than $1,500 but less than or equal to $5,000, or $75 if the claim is for more than $5,000.
The complaint is filed with the court, along with a filing fee and a summons. Once approved by a clerk of the court, the defendant will be given notice of the complaint and must respond with an answer. The defendant will have a set amount of time to respond to the complaint (generally, 21 days).
