The UCCJEA establishes that Texas courts have jurisdiction of custody cases if: The child has lived in Texas with a parental figure for at least six months before the case was filed. The child is under six months old and has resided in Texas with a parental figure since birth.
The UCCJEA requires courts in different jurisdictions to communicate when one court exercises emergency jurisdiction if there is a pending custody proceeding in a court in another state, or if a court in another state has issued a custody order involving the same parties.
Every state except Massachusetts adopted the UCCJEA as state law (and the law may soon change in Massachusetts to adopt the UCCJEA).
The UCCJEA addresses courts jurisdic- tion to modify existing child-custody or visitation determinations in two comple- mentary sections: section 202 establishes rules of continuing jurisdiction in the decree-granting State, and section 203 governs when another State may modify an existing decree.
