If you docHubed a conciliation agreement (COT3), the respondent might have agreed to pay you some money. Contact us if you do not get paid. Acas conciliators cannot force the respondent to pay, but they can: explain your options.
This could be a financial settlement in return for which youll agree not to go to a tribunal, or you might want your employer to agree to change the way theyre treating you. Early conciliation takes place before youve started your tribunal claim.
However, whereas a settlement agreement is more formal and requires the employee to obtain legal advice, a COT3 is through an ACAS conciliator who is neutral and will not take sides. ACAS does not advise either party on the merits of potential claims or the prospects of successfully defending those claims.
A COT3 is a form of settlement agreement that records the terms of settlement of an employment tribunal claim (or potential claim, if settled before an ET1 form is filed). The terms of the COT3 agreement will reflect what has been agreed between you and your employer.
The time it takes for a COT3 to be finalised depends on how much negotiation takes place between the parties involved. Once the terms are agreed, the timing of any payment will depend on what is agreed between the parties, although in practice this is often made within 14 21 days of the COT3 being signed.

The Acas conciliation officer will work from a standard COT3 template. This does not mean that you have to agree to every clause. You can negotiate for clauses to be changed, added or removed. Unlike Settlement Agreements, there is no requirement for you to obtain independent legal advice for the COT3 to be binding.
But a settlement agreement is a contract like any other contract and can lead to disputes about its interpretation or performance, bringing the parties together again when they thought everything was resolved.
