This guide explains standard representation agreements, sometimes called section 7 representation agreements. A standard representation agreement lets you choose a person to make or help you make health-care, personal-care, legal, or routine financial decisions. The person you choose is known as your representative.
A Representation Agreement is the only legal planning document in BC that covers health care and personal care matters. The authorities a representative can have are listed in two different sections of the RA Act. For short-hand you will hear RA7 and RA9 to describe two types of Representation Agreements.
With the Representation Agreement (Section 7) Form (PDF, 294KB) an adult may name a representative to help make decisions, or make decisions on behalf of the adult, with respect to personal care and health care, the routine management of financial affairs and obtaining legal services for the adult and instructing
The standard representation agreement, sometimes known as a RA7, has a lower threshold for capacity and is designed to be used by people with cognitive difficulties. Even if a person cannot manage their own healthcare matters, routine finances, or make a contract, they can enter into this agreement.
There is a capacity requirement to make a section 9 representation agreement: you must have the capacity to understand the nature and consequences of making the agreement. Section 7 representation agreements are more limited in scope, and most often used if you have already lost some mental capacity.

Section 7 Standard Powers (RA7) For adults whose cognitive capability to understand is in question. Adults may make an RA7 even if they are cognitively incapable to understand. The RA7 has a different definition of capability than for other legal documents.
Both an RA7 and RA9 cover minor and major health care matters including routine and risky tests, dental work, and surgery. An RA9 covers some additional powers/authorities for health care because an RA9 must be made by an adult who is capable of understanding what it means when they make it.
