Although it may technically be possible to get a subpoena without a lawyer, doing so carries with it certain risks. For example, if the proper person is not named, the party may not receive the documents that he or she is requesting. The subpoena must be listed in the persons name who actually has the records.
(1) A subpoena may be served by any person who is not a party and is not less than 18 years of age. Service of a subpoena upon a person named therein shall be made in the same manner prescribed for service of a summons and complaint in Rule 4(d) or (j).
The District of South Carolina requires that subpoenas for witnesses in criminal cases be delivered to the Marshal for service at least fourteen days before the Monday of the week in which the trial is set to begin, except as otherwise ordered by the Court.
