Subpoenas Directed to United States Citizens and Permanent Residents of the United States: 28 U.S.C. § 1783 authorizes the courts of the United States to issue subpoenas -- to a national or resident of the United States located in a foreign country -- to appear or to produce evidence.
Unlike subpoenas to be served in the United States, the clerk's office cannot routinely issue a subpoena to be served in a foreign country. The party seeking such a subpoena must move the court for an order directing the issuance of the subpoena pursuant to 28 U.S.C. § 1783.
Under the Georgia UIDDA, the foreign subpoena must be issued to a clerk of superior court in the county where the person receiving the subpoena resides. § 24-13-112. The clerk will then \u201cissue and provide to the requestor a subpoena for service upon the person to which the foreign subpoena is directed.\u201d Id.
An international subpoena is served when a deposition, testimony, discovery, or the producing of records and documents need to be conducted in or on a person residing in a country other than the one in which the case originates.
A party in an out-of-state proceeding who is requesting a Maryland subpoena must request issuance of a subpoena by submitting a foreign subpoena to the clerk of the circuit court for the county in which discovery is sought. The clerk then issues a Maryland subpoena that incorporates the terms of the foreign subpoena.
