The basic requirements are the same for both types of marriage. Both parties must be at least 18 years of age. Must have a valid, government-issued picture identification.
In Texas, an informal or common law marriage is a valid marriage that is created without all the formalities of a ceremony or a marriage license. The easiest way to prove a common law marriage is by signing a Declaration of Informal Marriage. Once signed, the Declaration is proof of a valid marriage in Texas.
Affidavits must be signed in front of a notary public. A notary must verify your identification before you sign the document. Bring ID (like a drivers license or other form of identification) for the notary before you sign the affidavit.
If you have a premarital education course certificate from Twogether in Texas, the fee is $21. If neither applicant is a resident of TEXAS an additional $100 will be charged. A declaration of informal marriage is $46.
As the non-incarcerated spouse, you are required to obtain the required licenses and arranging and payment of the officiant. The incarcerate spouse must be eligible for visits and submit an Inmate Request to an Official (I-60). The unit warden schedules all weddings based on approval of the I-60.
