Section 404 of the Clean Water Act requires authorization from the Secretary of the Army, acting through the Corps of Engineers, for the discharge of dredged or fill material into all waters of the United States, including wetlands.
In general, individual permits are for large projects that will have substantial impacts. Nationwide permits (which are general permits) are issued for smaller projects with minimal impacts. The greatest proportion of activities permitted is done so via a nationwide permit.
Section 404 requires a permit before dredged or fill material may be discharged into waters of the United States, unless the activity is exempt from Section 404 regulation (e.g., certain farming and forestry activities).
(a) The Secretary may issue permits, after notice and opportunity for public hearings for the discharge of dredged or fill material into the navigable waters at specified disposal sites.
There are three basic types of permits: Standard Permits, General Permits and Letters of Permission (LOP).

Any discharge of dredged and/or fill material into waters of the U.S. incidental to any of the exempt activities must have a permit if it is part of an activity whose purpose is to convert an area of a water of the U.S. into a use to which it was not previously subject, where the flow and/or circulation of waters may
A proposed projects impacts to these areas will determine what permit type is required. An individual, or standard permit, is issued when projects have more than minimal individual or cumulative impacts, are evaluated using additional environmental criteria, and involve a more comprehensive public interest review.
