Peremptory challenges are used by lawyers to exclude those jurors who the judge has determined that pass for cause (meaning that nothing has been said by the juror that would prevent him or her from being fair and impartial to either side). Usually, each side has the same number of peremptory challenges.
The term peremptory challenge refers to the practice of excusing potential jurors without providing a reason why. Jurors may also be excluded because the attorneys and the judge believe that the juror, for whatever reason, cant be fair. This is called a for cause challenge.
Attorneys may use peremptory challenges to remove jurors they suspect may be biased or who seem unsympathetic to their case. These challenges allow attorneys to shape the jury without needing to provide a reason, but must not be used discriminatorily.
: an exception pleaded by a defendant esp. on the basis that the law provides no remedy for the injury the plaintiff alleges, that the claim is barred by res judicata or prescription, or that an indispensable party has not been joined.
