Rules for Skipping Meal Periods in California If you dont work more than six hours, you can skip your meal period. If you work more than 10 hours, but not more than 12 hours, you can skip your second meal period, but you still have to take your first meal period.
If your employer is automatically deducting 30 minutes for a lunch break that you never actually take, they could be violating federal wage laws. Under the Fair Labor Standards Act, employers can only deduct for bona fide meal breaks where you are fully relieved of duty.
Some employees, particularly administrative or executive employees, may be exempt from certain lunch break laws in California. Either way, employees must be provided with their meal break before the end of their fifth hour of work.
If you have worked five hours or more, your workplace is required to give you a 30-minute meal break. Your meal break should begin sometime before the last hour of your shift. It is not required for you to take this meal break. If you have worked less than 6 hours in a day, you can agree to forego your meal break.
However, a meal break waiver is only allowed in very limited circumstances. If an employees shift is six hours or less, the meal period may be waived by mutual consent of the employer and employee. So, if an employee works six-and-one-half hours, she and her employer are prohibited from a meal break waiver.
