In Maryland, a divorce typically takes 30 to 120 days from the time of reaching a Marital Separation Agreement for it to be finalized, depending on court capacity and judge availability.
To get a copy of your divorce decree, contact the Circuit Court where your divorce was finalized. The Maryland Courts has a directory of Circuit Courts. The Division of Vital Records (Maryland Department of Health) verifies divorces and annulments that occurred on or after January 1, 1992.
To file for divorce, you can use form CC-DR-020 (Complaint for Absolute Divorce). The form lists other documents you need to attach to your complaint. You may also need to file a Civil Domestic Information Report(CC-DCM-001). There is a fee, but you may be eligible for a fee waiver based on your income.
There is now only one type of divorce in Maryland -- absolute divorce. Starting October 1, 2023, Maryland courts cannot grant a limited divorce. Maryland law on separation changed as well.
A mutual consent divorce is typically the quickest and most affordable way to end your marriage in Maryland, but its only available to couples who can reach an agreement on all of the issues in their divorce before filing the divorce complaint.
