FILING AN RJI. A case is assigned to a Justice by means of the Request for Judicial Intervention (fee $ 95). Certain applications do not require that a fee be paid, though an RJI form must be filed, and these applications will be assigned to an Ex Parte Justice, not to an Individual Assignment Justice for all purposes.
A form that a party files in a New York state court action that has not yet been assigned to a judge. The RJI is a request for the court to become involved in the matter and will result in the assignment of a judge, who will then preside over the action until its end.
The form must be completed and signed by the filing party. A copy must be served upon all other parties to the case with the papers to which the RJI relates. The RJI must be paid for in the cashiers office of the County Clerk (Room 160 or Room 141B). The cost for an RJI is $95.
Once an RJI is filed with the Court, the matter will be scheduled for a Preliminary Conference either before a Judge or a Court Attorney Referee. The time to get a Preliminary Conference date depends on the County but generally is 30-45 days unless there is an emergency issue.
The Satisfaction of Judgment form must be filed in the Court that entered the judgment, but if a Transcript of Judgment was filed in the County Clerks office, it must be filed there; and. Mail a copy of the Satisfaction within 10 days to the debtor; and.
