WRITTEN CONSTRUCTION AGREEMENT Whereas the CG 20 33 only provides additional insured status where there is a direct written contract, the CG 20 38 extends coverage to any other person or organization you are required to add as an additional insured under the contract or agreement.
The CG 2026 (also known as CG 20 26) additional insured endorsement represents a critical component of commercial general liability risk transfer strategies. This ISO form provides additional insured status to designated persons or organizations for liability arising out of the named insureds ongoing operations.
The main distinction between the CG 2033 and the CG 2038 is that the CG 2038 provides coverage for upstream parties. Upstream parties are the entities or individuals above the level where an entity is contracting.
The CG 2033 is the blanket additional insured form and is similar to the CG 2010. It only covers on going operations and requires that the insured be liable in whole or part for the loss before there is any coverage.
CG2038 4/13 This endorsement is very similar to CG2033. The primary difference between these two endorsements is that CG2038 applies to a party or parties requiring additional insured status within a construction agreement that are not the actual contracting party with the contractor.
