FERPA requires that a consent for disclosure of education records be signed and dated, specify the records that may be disclosed, state the purpose of the disclosure, and identify the party or class of parties to whom the disclosure may be made.
Generally, schools must obtain written consent from parents and eligible students before disclosing any personally identifiable information from a students education record, other than directory information. But there are many exceptions to this general rule.
FERPA is the Family Education Right and Privacy Act. It is a federal law that protects and affords the students right to their education records. Under FERPA, students education records can only be released to individuals outside of the university with the students explicit consent.
What are FERPAs Requirements? For the most part, FERPA requirements are fairly straightforward: Produce requested educational data to a parent, legal guardian or student within 45 days. Amend education records as requested (or prepare to hold hearings to contest amendments)
(a) The parent or eligible student shall provide a signed and dated written consent before an educational agency or institution discloses personally identifiable information from the students education records, except as provided in 99.31. (3) Identify the party or class of parties to whom the disclosure may be made.
