The Ninth Circuits large size is due to the dramatic increases in both the population of the western states and the courts geographic jurisdiction that have occurred since the U.S. Congress created the Ninth Circuit in 1891.
The Ninth Circuit is comprised of nine states in the western United States (Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington) and two territories (Guam and the Northern Mariana Islands).
For a civil appeal, approximately 6 - 12 months from the notice of appeal date, or approximately 4 months from completion of briefing. For a criminal appeal, approximately 3 - 4 months after briefing is complete.
Reply briefs may not exceed 7,000 words or, if handwritten or typewritten, 25 pages. See 9th Circuit Rule 32-1.
By most measures, the D.C. Circuit is among the least busy appeals courts in the nation, while the 9th Circuit is the busiest.
