On May 12, 2023, the US Court of Appeals for the Eleventh Circuit in Rosell v. VMSB, LLC held that FRCP 41(a)(2), governing voluntary dismissal of an action at a plaintiffs request by court order, allows only for the dismissal of an entire action and not individual claims.
