At a trial, a judge will decide which parent gets custody by considering: Which parent cares for the child most of the time. The childs relationship with other family members (for example, stepparents and step-siblings, grandparents, etc.) Each parents connection with and attitude toward the child.
Legal custody is not a factor in the child support calculation and does not determine who owes support. The child support obligation is based on income and is then reduced (credited) depending on the number of overnights.
What the paperwork costs. It costs about $300 for one parent to file a family case (divorce or custody) and another $300 for the other parent to respond.
In Oregon, a judge can only award joint custody when both parents agree that they want to have joint custody. If either parent objects to joint custody, then the Court will be forced to award sole custody to one parent (see ORS 107.169(3)).
You must go through a court case. You can start a court case by turning in court papers at the circuit court in the county where you or the other parent live. But turning in court papers is just the first step! If you are married to your other parent, you must start a divorce or legal separation case to get custody.
