What is the difference between a consent Judgement and a default Judgement?
Consent and default judgments are similar, and the only difference is in a consent judgment both parties agree, while in a default judgment the judge orders you to pay after failing to respond.
What are the three types of judgment?
Consent judgment is often used to stop litigation and to save on court costs. The judgement will be handed down in a consent decree that clearly states the terms of the agreement and what is expected of each party. A consent judgment becomes public record although some do have confidentiality clauses.
How bad is a judgement on your credit report?
A consent judgment is a final decision whereas, unless the case is dismissed, a consent agreement is not a final decision, it is a court order.
How does a consent judgement affect your credit?
If you agree to the consent judgment, you effectively request that the judge presiding over the case to enter a judgment against you. This is extremely risky since the adverse judgment against you could be reported to the three major credit bureaus, and it might torpedo your credit score.
How much will my credit score go up when a judgement is removed?
Yes; because of the judgement your credit score will be about 100 point lower as a result of that. It may take several years to recover from the initial judgement. Be sure to get the judgement reflecting SATISFIED because all judgements must be paid before you can get approved for a home loan.
