For sentences imposed on or after July 1, 2009, the record of your conviction may be expunged if you were under age 25 at the time of the offense and if the maximum punishment for the crime was 6 years or less. Some offenses are excluded, and felony offenders are not eligible if they have a prior felony conviction.
Under the Act, an offenders criminal record may become spent if they do not re-offend for a period of 10 years. Offenses resulting in a prison term of more than six months will not become spent.
People with misdemeanors and lower-level felony records will be eligible after seven and ten years, respectively. Charges for sex, family violence, and firearms are not eligible.
