Effective March 1, 2024, New York law applies revised income caps for calculating child support payments and maintenance obligations. The income cap for child support calculations has increased to $183,000. The income cap for maintenance calculations now stands at $228,000.
You should expect to receive a hearing date within 30 to 45 days after filing and serving the necessary documents. This timeframe is reasonable for scheduling on the courts calendar here in California. You should file as soon as possible, and the court will set the date accordingly and notify all parties involved.
You can ask the court to modify your current obligation amount (with Family Court Form 4-11) based on a substantial change in circumstances, or if the order was effective on or after October 13, 2010, it may be modified if: Three years have passed since the order was entered, last modified, or adjusted.
