19A-29.1. License required for commercial breeder; penalty. (a) No commercial breeder shall operate in the State without first obtaining a commercial breeders license. Application for a license shall be in the manner provided by the Director.
While the laws vary, they generally require a person who meets the definition of a commercial breeder to obtain a license, pay a fee (which often varies depending on how many dogs the person breeds), have his or her breeding facilities inspected, and maintain certain minimum standards of care.
Only in the patchwork of laws on the local level is there any regulation of this breeding activity. The only federal law governing dog breeding is the Animal Welfare Act (AWA).
Dog breeders who breed puppies to be sold as pets must be USDA-licensed if they have more than four breeding females and sell puppies wholesale, or sight unseen, to pet stores, brokers and/or online.
YES, YOU MAY NEED TO BE LICENSED BY THE USDA! The USDA Retail Pet Store rule exempts certain dog breeders from USDA licensing and identifies which breeders may be subject to USDA licensing.
