To find a local process server, visit .canada411.ca and search for process server. Whoever serves must do it in-person and by hand-delivering a copy to the other party or their lawyer. This is called personal service.
A party must complete and file an Affidavit in Support of Substitutional Service. The Affidavit needs to specify how the documents will be substitutionally served and why, if served in the requested manner, they would come to the attention of the other party.
Unless the documents require special service, you can serve by email, but there are special rules. You need the permission of the court or of the other party, and you will need to file the email along with your Form 6B: Affidavit of Service.
File both the original defence (with any supporting documents and affidavit(s) of service) and a copy for yourself and each defendant, with the court in person or by mail, or file the defence and documents online using the Small Claims Court Submissions Online portal at .ontario.ca/page/file-small-claims-online .
In the case of service by email, a specified method can be agreed so that the receipt of court documents may be managed and monitored properly. Service of documents by email is opt-in. Simply because correspondence is sent by email between the parties does not mean a court document may be served by email.
Regular service If the other party agrees, or if a judge orders it, you can also serve the document by electronic document exchange. If you serve by fax, email, or an electronic document exchange, the first page of the fax, body of the email or record of service should include: date and time of the service.
Completing an Affidavit of Service Follow the instructions on Form 16B to fill out the Affidavit of Service. The affidavit will describe: the name of the person who served the document. what document was served (for example, Notice of Appeal to the Divisional Court or Notice of Motion)
Rule 4A (1) of the Uniform Rules of Court provides, inter alia, that the service of documents and notices in any proceedings may be effected by facsimile or electronic mail to the respective addresses provided. Rule 4A (4) further provides that service under this Rule need not be effected through the Sheriff.
