At its most basic, BAAs must contain these provisions: Determine what PHI the Business Associate will access. Require that the Business Associate will use appropriate safeguards to secure PHI. Provide that the BA will not disclose protected health information save when permitted by the agreement.
Services provided by business associates can be accounting, billing, claims processing or data management. And of course, these are just a few examples of each. Covered entities hold the responsibility for guaranteeing its business associates are safeguarding protected health information.
The HITECH Act required business associates of HIPAA covered entities to enter into a business associate agreement (BAA) with HIPAA-covered entities and agree not to disclose PHI other than for reasons permitted by the HIPAA Privacy Rule.
A business associate subcontractor agreement (referred to as a subcontractor BAA) is a legally binding contract between (1) a business associate of a covered entity; and (2) a business associate of that business associate.
The final rule stated that any organization that provides a covered entity with data transmission services involving PHI and that requires access on a routine basis to such PHI will be considered a business associate, including but not limited to health information organizations and e-prescribing gateways.
The business associate amendment requires that a provider cannot request Google use or disclose PHI in any manner that would not be permissible under HIPAA, if done by a covered entity itself (unless otherwise expressly permitted under HIPAA for a Business Associate).
The HIPAA Rules generally require that covered entities and business associates enter into contracts with their business associates to ensure that the business associates will appropriately safeguard protected health information.
