HB 337 Original 2023 Regular Session Carpenter Abstract: Eliminates the requirement of a minimum child support award. Present law (R.S. 9:315.14) prohibits a court from setting a child support award below $100 per month except in cases involving shared or split custody or a medically documented disability.
Louisiana law provides that the maximum amount withheld from a person weekly disposable earnings for the payment of current and/or past due support may not exceed fifty percent (50%).
Louisianas guidelines spell out what counts as income in the child support calculations. Generally, a parents income does not include a new spouses income. However, judges may consider a new spouses income to the extent that its used to directly reduce the parents actual expenses.
You can go to the Department of Children and Family Services (DCFS) to request a review. DCFS may ask the court to modify the existing child support order. All child support modifications go through the court process. DCFS can help you through the process if you have an existing or open child support case.
Visit the DCFS website. Go to the Child Support Enforcement section. Click Apply for Services. Complete the application form by providing the required information about yourself and the non-custodial parent. Mail Application: Alternatively, download the application form from the DCFS website.
