The big take-away is that in most circumstances a landlord cannot enter a property without agreement from the tenant. And If the landlord ignores the law and enters the property without permission, the tenant may be able to claim damages or gain an injunction to prevent the landlord doing it again.
The end of a fixed term tenancy or lease does not mean that the tenant has to move out or sign a renewal or new lease in order to stay. The lease is renewed automatically on a month-to-month basis (if the rent is paid monthly) or week-to-week basis (if rent is paid weekly).
In Ontario, when a residential lease expires, and there is no new lease, the tenancy automatically becomes a month-to-month tenancy. The main advantage for tenants with a month-to-month tenancy is that they have much more flexibility if they decide to move.
Lease Effective Date means the effective date of the Lease (or the date the term of the Lease begins) that is shown, or to be shown, on the Lease agreement between the Owner and a tenant. [Adopted 1/10/08.] Lease Effective Date means the first day of the Month in which the Substantial Completion Date occurs.
Landlords are required to give their tenant at least 60 days written notice to the end of the term or rent period using the Landlord and Tenant Board Form N12. Be sure you are using the current form N12 updated on July 28, 2020 and it can be found at .
Most commercial lease terms are going to be 3-5 years long starting on the first of the month and expiring 3-5 years later at the end of the month-prior to the lease start date. For example: In a 3 year lease that commenced on 2/1/2020 the lease would end on 1/31/2023.
Fixed-term: If you have a fixed-term tenancy, like a one year lease, then you must give notice at least 60 days before the end of the lease. The termination date cannot be before the last day of the fixed term. If you dont give notice, the tenancy continues.
