Resolution 377 A (V) maintains that an ESS of the General Assembly can be called if requested by the Security Council on the vote of any seven members [nine since 1965 when the Council expanded from 11 to 15 members], or by a majority of the Members of the United Nations.
The most important part of resolution 377 A (V) is section A which states that where the Security Council, because of lack of unanimity of the permanent members, fails to exercise its primary responsibility for the maintenance of international peace and security, the General Assembly shall seize itself of the matter.
The resolution was passed with an overwhelming vote of 143 in favour, 5 against and 35 abstaining. This resolution achieved more votes in favour of condemning Russias actions than Resolution ES-11/1, the initial resolution on the Russian invasion of Ukraine which demanded that Russia withdraw its forces from Ukraine.
The only resolutions that have the potential to be legally binding are those that are adopted by the Security Council. This explains why Member States consider it so important to adopt a resolution that has the widest possible agreement among Member States.
