A lockout is a work stoppage or denial of employment initiated by the management of a company during a labour dispute. In contrast to a strike, in which employees refuse to work, a lockout is initiated by employers or industry owners.
Ontario has now passed legislation making it illegal for 55,000 education workers represented by the Canadian Union of Public Employees to strike and imposing a contract on them.
A lockout is imposed by the employer. It means the employer prevents the workers from attending work. The employer does this in order to scare members of the union into accepting deep cuts and take-aways to their working conditions, wages and benefits.
The law recognizes 2 grounds for the valid exercise of the right to strike or lockout, namely:Collective Bargaining Deadlock (CBD) and/or Unfair Labor Practice (ULP).It is the outcome of a continuing process of enhancing mutual trust and respect through: information sharing. discussion. consultation. negotiations.
What is strike pay? Strike pay is a payment provided by trade unions to a striking member of the union. The payment made by unions is made to support the entitled workers in satisfying their basic needs while they are on strike.
Strike pay is provided to members who complete strike-related duties assigned by their Local Strike Committee. Only signed-up members are eligible to receive strike pay. During weeks one to three, each member is entitled to strike pay of $150 per week plus an additional $24 per week, per dependant.
Impacts to employee pay Employees that are in a legal strike position will continue to be paid normally until they withdraw their services. Absences due to strike activity will be coded as leave without pay and will be deducted from employees normal and regularly scheduled hours of work.
A Labour Board-supervised strike vote (unions) or lockout poll (employers) must be taken and a majority of those voting must agree to the strike or lockout. One party must serve the other (as well as the mediator) with 72 hours of notice before the strike or lockout commences.
Employers do not need to pay anyone who is on strike. Employees who go on strike will not usually get their pay or other contractual benefits like pension contributions. In some circumstances, they might get money from their union. This is sometimes called strike pay.
Although they are not working and do not receive a paycheque, striking workers are still considered employees. They cannot be terminated for being on strike. When the strike ends, they must be reinstated in preference to any employee hired to replace them during the strike.
