Driving hours accumulated before and after the sleeper berth time should total to 15 hours maximum. Driving is prohibited after 18 hours of on-duty periods accumulated before and after the sleeper berth time. None of the off-duty time is deferred to the next day.
The mechanics of split sleeper berth. Section 395.1(g) of the federal hours of service rules says that drivers whose trucks are equipped with a sleeper berth can obtain the equivalent of a 10 hour off duty break by taking 2 separate non-consecutive breaks that together equal at least 10 hours.
The split sleeper berth rule allows a driver to extend an on-duty shift by splitting the required 10 consecutive hours of off-duty time into two shifts. This allows drivers to adjust schedules for things like longer hauls or warehouse hours by dropping-in a rest break that pushes out a 14-hour driving period.
The rule is that drivers can split their off-duty time if one of the chunks is at least two hours long and the other is comprised of at least seven consecutive hours spent in the sleeper berth. The two-hour chunk does not have to be spent in the berth. The two chunks of time must add up to at least 10 hours.
With the 8/2 split, Seidl said a driver could drive for 6 hours and then take a 2-hour off-duty break and then drive for another 5 hours. At that point, an 8-hour off-duty period would commence and, when combined with the 2-hour off-duty break, provide the 10 hours of equivalent off-duty time as required by FMCSA.
As long as the 2 periods add up to 10 hours and the longer period is a sleeper berth status of at least 7 hours, this can be considered a sleeper split. You can look at the sleeper split as a 7/3, 8/2, 2/8, or 3/7.
The 7/3 sleeper berth split: In a 7/3 split, you start with 7 consecutive hours off in sleeper berth status and then complete your required break by taking your next 3 hours later in the day. Similar to the 2/8 split, you can take a 3/7 sleeper berth as well.
A driver may use a 7/3-split (sleeper berth for 7 hours, 3 hours off-duty) or an 8/2 split (sleeper berth for 8 hours, off-duty for 2 hours). Commodity drivers are still prohibited from driving more than 11 hours inside the 14 hour window.
