Hi my name is Dan Dalton and Im a religious land use attorney in Detroit Michigan with the firm of Dalton and Tomich. Today were going to address one of the most commonly asked questions from clients whether they be churches a mosque temples or synagogues what is a conditional use permit? Under your zoning code you generally have uses that are permitted as of right, the uses that are conditional uses or you have uses that are not permitted uses. The uses as of right is a simple one. Thats those uses that are directly permitted under the zoning code so you dont need any special approval for those uses. So if your zoning code allows in your district for churches or for schools or cemeteries or campgrounds you can go ahead and build one right in that area. No permissions needed. Whats an excluded use? Thats very simple as well. In your zoning code if it says you cannot have these types of uses those are specifically excluded so if it says no churches mosques temples in the zon

A variance is a request by a property owner to deviate from current zoning laws for any number of reasons. A zoning law, or zoning ordinance, is put in place by a local governing body to dictate how property in a particular area or zone can be utilized.
A zoning variance provides a property owner with the legal permission to build structures or use land in ways that are contrary to existing local zoning conditions.
A variance allows a property to be used in a manner forbidden by the zoning ordinance. If the purposes of a zoning ordinance are held in a bucket, and variances (leaks) are granted that compromise ordinance purposes, then over time the purposes of the ordinance are lost.
Conditional zoning means, as part of classifying land within a locality into areas and districts by legislative action, the allowing of reasonable conditions governing the use of such property, such conditions being in addition to, or modification of the regulations provided for a particular zoning district or zone by
Zoning variances are used when a proposed development is requesting an exception to some portion of the zoning law. A variance may sound similar to rezoning, but it does not involve changing the zoning law the way that rezoning does its more of an approved exception to the existing zoning law.
The primary purpose of a conditional use permit is to allow for a piece of land to be altered in how it can be used in ance with the local zoning ordinance. In many situations, these permits are granted because the public believes that the new use of land will benefit the community.
Conditional Use Permit (CUP) This is the process which an activity or structure may be permitted in a zoning district through a special permitting process with public input and a determination that the proposed use is consistent with applicable land use regulations and the character of the neighborhood.
Whats the Difference Between a Conditional Use Permit vs Variance? A variance is similar to a conditional use permit in that it is a limited exception to a zoning ordinance. However, variances are given out in situations where the zoning law would create unnecessary hardship or difficulty for the property owner.
