The rule is simple: You cannot just pull any picture from your internet search and use it in your branding strategy. Every piece of content (published and unpublished) gains copyright as soon as it is created. This means that any image you come across on the World Wide Web may be backed by copyright laws.
Its important to know that giving credit on its own does not entitle you to use an image. For instance, an image published under an All Rights Reserved license (the default copyright grant, unless stated otherwise), means no rights are granted for any use.
In general, the permissions process involves a simple five-step procedure: Determine if permission is needed. Identify the owner. Identify the rights needed. Contact the owner and negotiate whether payment is required. Get your permission agreement in writing.
Obtaining permission You send a letter to the holder asking for permission and stating how you intend to use the image. The holder sends a letter back granting you permission. Your request should be as specific as possible in describing the intended use of the image.
Copyright-free images will have the Public Domain Mark 1.0 or the CC0 1.0 Universal Public Domain Mark. Public domain images do not require any citation. You can obtain public domain images on sites like Wikimedia Commons and Flickr Commons.
How to check the copyright for an image? Look for an image credit or contact details. Look for a watermark. Check the images metadata. Do a Google reverse image search. Search the U.S. Copyright Office Database. +1. If in doubt, dont use it.
Heres our collection of tips and best practices to help you prevent your images from being copied or stolen online. Register the copyright to your work. Use a copyright notice. Watermark your work. Use a digital signature. Include hidden foreground layers. Edit EXIF data. Use low-resolution images. Adjust the color profile.
Register Your Images With the U.S. Copyright Office Registration within five years of the images publication provides prima facie evidence of your copyright claim. Registration is required before you can file any copyright infringement action in court for works of U.S. origin.
One way to make sure your intended use of a copyrighted work is lawful is to obtain permission or a license from the copyright owner. Contact a copyright owner or author as far as pos- sible in advance of when you want to use the material specified in your permissions request.
Photographs, illustrations and other images will generally be protected by copyright as artistic works. This means that a user will usually need the permission of the copyright owner(s) if they want to perform certain acts, such as copying the image or sharing it on the internet.
